Terms & Conditions

These Terms govern every purchase and use of an ActivePass Pack or Open Pack gift card sold at activepass.ie. ActivePass is a trading name of Wiseclutch Ltd, a company registered in Ireland ("ActivePass", "we", "us"). By completing a purchase you agree to be bound by these Terms, and by the specific redemption conditions of each Partner venue named on your Pack.

1. Definitions

"Pack" means a fixed bundle of activities purchased as a single product (e.g. the Family Pack). "Open Pack" means a flexible gift card redeemable at face value with any listed Partner. "Voucher" means the unique code or document issued to you on purchase. "Partner" means an independent, third-party activity provider listed on the site. "Activity" means the specific experience delivered by a Partner. "You" means the purchaser or, where a Voucher has been gifted or transferred, the current lawful holder.

2. Who We Are, and What We Do

ActivePass is a booking and payment intermediary. We curate Packs, take payment from you, issue your Voucher, and pay the Partner once your Activity is confirmed as delivered.

This split of responsibility is set out clearly so that, if something goes wrong with the Activity itself, you know who is responsible: the Partner delivers it, we facilitate the booking and payment.

3. Placing an Order

Orders are made through activepass.ie and paid for by card via Stripe. A contract is formed between you and ActivePass when we send you an order confirmation email with your Voucher attached. We reserve the right to decline or cancel an order (for example, in the case of a pricing error or suspected fraud), in which case you will receive a full refund.

Each Pack lists the specific Activities and Partners included. To redeem:

If a Partner is unavailable

If a Partner permanently withdraws from the Activity listed on your Pack, we will offer a comparable substitute Activity of equal or greater value at no extra cost, and notify you by email in advance of any change.

6. Pricing and "Worth" Comparisons

Where we show a Pack's price alongside a "Worth €X" figure, that figure reflects the sum of each included Activity's genuine, current standalone price as charged by the Partner at the time of listing. These reference prices are reviewed regularly and may change if a Partner changes their own pricing; we will not knowingly advertise an inflated or invented reference price. All prices are shown in Euro and include VAT where applicable.

7. Your Right to Cancel (Cooling-Off Period)

Under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013), you have the right to cancel your order within 14 calendar days of purchase, for any reason, provided your Voucher has not yet been redeemed, in whole or in part. To cancel, email hello@activepass.ie — you do not need to give a reason. We will refund you within 14 days of receiving your cancellation notice, using your original payment method.

Important exception once you've booked a specific date

Once you use your Voucher to book a specific date and time directly with a Partner, that booking relates to a leisure activity for a specific date, which is treated differently under consumer law — the Partner's own booking and cancellation terms will apply to that specific appointment, not the 14-day window above. Check the relevant Partner's cancellation policy before booking if your plans might change.

8. Refunds Outside the Cooling-Off Period

Outside the 14-day cooling-off period, or once any part of a Voucher has been redeemed, your purchase is non-refundable — but your Voucher remains valid and usable for its full 5-year term. The only exception is where ActivePass is in breach of these Terms or the Consumer Rights Act 2022 (for example, if we fail to issue a valid Voucher at all).

9. Service Standards (Consumer Rights Act 2022)

Activities delivered by Partners must be provided with reasonable care and skill and be in conformity with the description given on activepass.ie. If an Activity is not delivered, or is delivered defectively, you are entitled to a remedy under the Consumer Rights Act 2022 — in the first instance, contact us and we will work with the relevant Partner to arrange a repeat Activity, a comparable substitute, or, where appropriate, a refund of that portion of your Pack.

10. Liability

ActivePass's liability is limited to our role as booking and payment intermediary: issuing a valid Voucher, maintaining accurate listings, and processing payments to Partners correctly. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud, to the extent such limitation is not permitted by Irish law.

Delivery of the Activity itself

The Activity is delivered by the Partner, not by ActivePass. Each Partner is contractually required to hold public liability insurance covering the Activity for its duration. Claims relating to injury, loss, or damage arising during an Activity should be directed to the Partner and their insurer in the first instance; we will assist in facilitating that process.

11. Corporate and Bulk Purchases

Businesses purchasing Packs or Open Pack gift cards in bulk for staff or client gifting are subject to these Terms in addition to any separate corporate agreement signed with ActivePass. Bulk orders are invoiced separately and are subject to the same 5-year validity and redemption rules as individual purchases.

12. Complaints

Email hello@activepass.ie with any complaint. We aim to acknowledge within 2 business days and resolve within 10 business days. If you remain unsatisfied, you may refer your complaint to the Competition and Consumer Protection Commission (ccpc.ie) or, for cross-border EU purchases, the European Consumer Centre Ireland (eccireland.ie).

13. Intellectual Property

The ActivePass name, logo, and website content are the property of Wiseclutch Ltd and may not be reproduced without permission.

14. Changes to These Terms

We may update these Terms from time to time; the version in effect at the date of your purchase applies to that purchase. Material changes will be posted on this page with an updated date.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Ireland, and the Irish courts have exclusive jurisdiction over any dispute, without prejudice to your right as a consumer to rely on mandatory protections of your own country of residence if you are based elsewhere in the EU.
